TERMS OF SERVICE Last updated: May 12, 2026

1. Acceptance By downloading, accessing, or using the Trust My Gut mobile application (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the App.

2. Not Medical Advice Trust My Gut is a wellness and nutrition tracking app. It is not a medical service, medical device, or a substitute for professional healthcare. Nothing in the App — including meal analysis, gut scores, insights, coaching responses from our AI assistant Fiyah, daily vitals displays, or any other content — constitutes medical advice, diagnosis, or treatment.

Always consult a qualified healthcare provider before making changes to your diet, lifestyle, or wellness routine, and especially if you have an existing medical condition, are pregnant or nursing, or have food allergies. Do not use the App to diagnose or treat any health problem. If you experience a medical emergency, call your local emergency services immediately — do not rely on the App.

3. AI-Powered Features and Fiyah Trust My Gut includes AI-powered features, including “Fiyah,” our nutrition coaching assistant. These features are powered by Claude, an AI model developed by Anthropic, PBC.

You acknowledge and agree that:

• AI-generated responses, meal analyses, insights, suggestions, and personalized notifications are produced by a machine learning system and may contain errors, inaccuracies, or outdated information.
• AI output is provided for informational and educational purposes only and is not a substitute for personalized advice from a qualified professional.
• You should not rely on AI-generated content for medical, nutritional, or health decisions without independent verification.

Before any data is shared with Anthropic to power these features, you must provide explicit consent through our in-app AI Consent screen. You may revoke this consent at any time in Profile → AI & DATA.

When consent is revoked, AI-powered features will be disabled.

If you have granted Apple Health access (see Section 4), a summary of your current vitals may be included in the context sent to Anthropic to enable real-time personalization. Full details on what data is shared, who receives it, and the protections in place are available in our Privacy Policy.

4. Apple Health Integration and Connected Wearables Trust My Gut integrates with Apple HealthKit on iOS to read health metrics from any wearable or app you have connected to Apple Health. Supported sources include Apple Watch, Oura Ring, Garmin, Fitbit, Strava, and similar services.

You acknowledge and agree that:

• Apple Health metrics displayed in the App are read from third-party devices and apps you have connected to Apple Health. The accuracy of this data depends on those third-party sources. Trust My Gut does not validate, modify, or guarantee the accuracy of data from connected wearables or apps.
• Trust My Gut reads Apple Health data on a read-only basis. We never write, modify, or delete data in Apple Health.
• Apple Health data is used solely to personalize your in-app experience, including meal recommendations, Fiyah’s coaching, your home greeting, daily check-in notifications, and Daily Vitals displays.
• You can disable Apple Health integration at any time in Profile, which immediately stops the App from reading any Apple Health data.
• You can revoke individual Apple Health permissions in iPhone Settings → Health → Data Access & Devices → Trust My Gut.
• Declining or revoking Apple Health access does not affect any other App features. All vitals can be logged manually.

You should not rely on Daily Vitals or Apple Health metrics shown in the App for medical or diagnostic decisions. Always defer to your healthcare provider for interpretation of health data.

5. Subscriptions Trust My Gut offers Trust My Gut Premium, an auto-renewable subscription available as:

• Monthly plan — $6.99 per month
• Annual plan — $59.99 per year

New subscribers may be eligible for a 7-day free trial. If you start a subscription during the trial, any unused portion of the trial is forfeited.

Payment will be charged to your Apple ID account at the confirmation of purchase. Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the price shown above. You can manage and cancel your subscription in your Apple ID account settings at any time.

6. User Responsibilities By using Trust My Gut, you agree that:

• You are at least 13 years of age (or the minimum digital age of consent in your jurisdiction).
• You are responsible for maintaining the security and confidentiality of your account credentials.
• You will not misuse the App, attempt to gain unauthorized access to its systems, reverse engineer or modify the App, or use it for any unlawful purpose.
• You will not use the App for medical emergencies or time-critical health decisions.
• Any information you provide (quiz responses, meal logs, symptoms, manual vitals, etc.) is accurate to the best of your knowledge.

7. User Content You retain ownership of any content you submit to the App, including meal descriptions, photos, check-ins, manual vitals entries, and notes (“User Content”). By submitting User Content, you grant Trust My Gut a worldwide, non-exclusive, royalty-free license to use, store, display, and process that content solely for the purpose of operating and improving the App and providing its features to you.

You are responsible for ensuring that any User Content you submit does not infringe on the rights of others and complies with applicable law.

8. Data and Privacy Your privacy matters. Our Privacy Policy explains what data we collect, how it’s used, and your rights — including the right to request account deletion. By using the App, you consent to the data practices described in our Privacy Policy.

You may request deletion of your account and associated data at any time through the in-app “Delete Account” option or by contacting us at info@trustmygutapp.com.

9. Third-Party Services Trust My Gut integrates with several third-party services to deliver its features:

• Anthropic (for AI processing via Claude)
• Apple HealthKit (for reading health data from your device)
• Google Places API (for restaurant search functionality)
• Supabase (for database and authentication)
• RevenueCat (for subscription management)
• Apple App Store (for billing and account services)

Your use of these third-party services through the App may also be subject to their respective terms of service and privacy policies. We are not responsible for the practices, policies, or content of these third parties.

10. Intellectual Property All content, features, branding, logos, design, software, and functionality of the App — other than your User Content — are owned by Trust My Gut or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the App without our prior written permission.

11. Disclaimers and Limitation of Liability The App is provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, Trust My Gut shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or health outcomes, arising from your use of the App — even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim, or $50 USD, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

12. Termination We reserve the right to suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or engage in behavior that we reasonably believe is harmful to other users, the App, or us. You may also terminate your account at any time using the in-app account deletion feature.

13. Changes to These Terms We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and notify you through the App or by other reasonable means. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law and Dispute Resolution These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms or the App will be resolved in the state or federal courts located in Newark, New Jersey, and you consent to the personal jurisdiction of those courts.
